New tonight, the states High Court says a mandatory life sentence for Knoxville man convicted of murder as a 16 year old is unconstitutional. It does not change the sentence for Tyshawn Booker, but it granted him a parole hearing after he serves between 25 and 36 years in prison. Justices ruled narrowly that juveniles convicted of first degree murder will no longer get a mandatory 51 year sentence. Booker is 23 but was convicted back in 2018 of murder. And especially aggravated robbery. The ruling says a judge has the discretion to impose a lesser sentence for juvenile homicide offender based on age and other circumstances. The ruling says the judge in Bookers trial had no sentencing discretion. Booker was 16 when he was charged in the deadly 2015 shooting in East Knoxville. The court says Tennessees automatic life sentence of 51 to 60 years for juvenile offenders is an outlier in the nation. And no other state poses a mandatory sentence longer than 50 years.
