Rule 35 is amended in order to make it clear that a judge may, in his discretion, reduce a sentence of incarceration to probation. To the extent that this permits the judge to grant probation to a defendant who has already commenced service of a term of imprisonment, it represents a change in the law.
Section 5k1. 1 of the United States Sentencing Guidelines reads, in part, as follows: Upon motion of the government stating that the defendant has provided substantial assistance in the investigation or prosecution of another person who has committed an offense, the court may depart from the guidelines.
1 section specifies that if a defendant has provided substantial assistance to the government in investigating or prosecuting someone else who has committed a crime and the government makes a motion that cites 18 U.S.C. 3553(e), the court is empowered to issue a sentence below the applicable mandatory minimum sentence.
994(o), upon motion of the defendant or the Director of the Bureau of Prisons, or on its own motion, the court may reduce the term of imprisonment, after considering the factors set forth in section 3553(a) to the extent that they are applicable, if such a reduction is consistent with applicable policy statements
Federal Rule of Criminal Procedure 35(b) permits a court, upon the governments motion, to impose a new, reduced sentence that takes into account post-sentencing substantial assistance, and that new sentence may go below the recommended guideline range and any statutory mandatory minimum penalty.
