The courts have the right to invalidate an entire prenuptial agreement, or portions of it, if it is considered unreasonable or unfair. In particular, a judge might throw out child support or custody agreements as outlined in a prenuptial agreement if these agreements are not in the best interest of the child.
The bottom line is that cheating does not void a prenup. However, it may have an impact on negotiations, especially if an infidelity clause is involved. Be warned though, the validity and enforceability of infidelity clauses varies from state to state.
Ontarios Family Law Act permits a court to set aside a prenuptial agreement or any portion thereof if a party failed to disclose docHub assets or liabilities, if a party did not understand the nature or consequences of the contract, or otherwise, in ance with the law of contract.

Many couples are surprised to find out what may and may not be included in such agreements.
Protections Against the Other Spouses Debts Without a prenup, creditors can go after the marital property even though only one spouse is the debtor. To avoid this, limit your debt liability in a prenuptial agreement.
