There must be a cessation of work. Cessation means abandonment, stoppage of work or reluctance to perform the duties of their posts. It is the most important characteristic of the strike. It is stoppage of work or refusal to continue work that the employees are required to do.
The primary purpose of discovery is the production of evidence for use at trial while a bill of particulars is used to clarify the date, time, place and manner of the offense to make it easier for the defendant to prepare his defense.
Upon refering to the Rules of civil Procedure, Rule 25.10 will show that a party may demand particulars, meaning request additional details, from the party whose pleading failed to provide sufficient information.
Particulars are essentially the evidence that backs up a claim, and the actual claim itself is what you should argue against. A good disputes and litigation lawyer will set out the relevant facts in response to claims to support your legal position and provide your own correct particulars.
The Rule permits a motion only on a question of law at the very preliminary stage of a proceeding and covers a very narrow scope. The Rule asks whether (i) based entirely on the content of the pleading; (ii) there is a question of law that will dispose of the action or an issue therein.
A motion to strike is when one party is asking the judge to remove all or part of the claim. The judge will either leave the pleading as it is, strike the offending portion with leave to amend, or strike it without leave to amend.
A demand for a bill of particulars in California is authorized by Code of Civil Procedure section 454 and is an excellent tool for forcing a plaintiff to itemize the total sum upon which the complaint is based.
A bill of particulars is defined as a written itemization of claims in a lawsuit that the defendant may demand of the plaintiff in some situations in order to clarify the details of the claims.
