Any assets acquired during the marriage form the net family property and each spouse has an equal entitlement to half their value.
Under the Ontario Family Law Act, legally married couples who want to separate must divide their property equally, including everything owned and everything owed. In order to be eligible for spousal support, one must demonstrate a need for it in both short-term and long-term marriages.
The amount of support ranges from 1.5 to 2 per cent of the difference between the spouses gross income amounts for each year of marriage or cohabitation, up to a maximum of 50 percent, (where 50 percent represents an equalization in income).
When a married couple decides to separate and go their separate ways, it is generally expected that property and assets will be divided equally. In fact, ing to the Family Law Act in Ontario, it is required that assets that have been accumulated over the course of the marriage are divided 50/50 in the divorce.
The general rule is that the net value of the family property (the value of the property owned by the spouses minus any debts and excluded property) be equally divided between both spouses in a divorce.
In Ontario, property acquired during a marriage must be split equally when a marriage ends for any reason.
When a divorce occurs and a business has been incorporated, a spouse can take the company by receiving assets used by the business or by dividing shares in the corporation. Legal guidelines set by the Family Property Act dictate that assets are generally to be divided equally between partners.
Separation Agreements are often overturned on the basis that one or both spouses did not obtain independent legal advice at the time that they executed their Agreement. Independent legal advice will strengthen an agreement in two important ways.
