i occasionally run into a situation where a client is wanting to file for a name um to protect that with a trademark and that name is unavailable then we do further research into the owner of the mark and how theyamp;#39;re using the mark and weamp;#39;re unable to determine whether theyamp;#39;re actually using the mark at all in this instance the client has the option to docHub out to the trademark holder themselves or have an attorney do that for you and attempt to purchase the registration from the holder of that however if you donamp;#39;t have any luck with that thereamp;#39;s still an option to cancel the registration of the previous owner of the trademark if theyamp;#39;re not actually using it in commerce this is a common misnomer where people feel that once you own the trademark you have it for life thatamp;#39;s not actually true you have to continue using the mark in commerce
