P. 1. Spoliation is [t]he intentional destruction, mutilation, alteration, or concealment of evidence, usu[ally] a document. 6 The spoliation doctrine is invoked when a party alleges that its opposing party has caused a crucial piece of evidence to be unavailable.
Spoliation, especially if its intentional, can also leave you vulnerable to court-ordered sanctions. These can range from fines to civil penalties to even felony charges.
The motion to strike out evidence in Virginia may be directed against a particular item of evidence, the testimony of a particular witness, or it may be used to strike all the evidence. This article deals with the motion to strike out all the evidence of one of the parties to the litiga- tion.
Both plaintiffs and defendants can be liable for spoliation. Spoliation of evidence occurs when some- one with an obligation to preserve evidence related to a legal claim either neglects to do so or intentionally fails to do so.

The basic purpose of statements of case (ie particulars of claim or a defence) is straightforward. They enable the opposing party to know what case is being made against them.
