our non-competes in the U.S now illegal not exactly this is what you need to know so today January 5th the Federal Trade Commission issued a notice of proposed rulemaking about non-competes we knew this was coming but I dont think everyone expected it to be quite this broad because if as written this went into effect it would strike down all existing non-competes and prohibit future non-competes throughout the U.S two key things one is timing nothing happens today because now theres a 60-day period where the public can comment then the FTC decides whether to make any changes to a final rule then that would take effect six months afterwards so nothing official would happen until end of this year or even beginning of next if things get extended to a substance so this would strike down all non-competes but would not affect confidentiality or non-solicitation of customer agreements unless those were so broad to basically be a non-compete so what can businesses do in the meantime well it

Employers are no longer permitted to issue non-compete agreements to their employees in Ontario. The province is the first in Canada to implement this ban, which came into effect on December 2, 2021. What is a non-compete agreement?
Many Non-Competes are unenforceable because they restrict competition across too broad of a territory. Non-Competes usually describe a restricted area in which the employee cannot compete.
Although most states allow enforcement of reasonable non-competes, the increasing trend is to limit or ban their use. In California, North Dakota, the District of Columbia, and Oklahoma, non-competes are either entirely or largely unenforceable as against public policy.
Typically, the only way to fight a non-compete agreement is to go to court. If you are an employee (or former employee) who signed such an agreement, this means you must violate the agreement and wait to be sued. It may be that your former employer has never sued another employee to enforce the non-compete agreement.

Specifically, the FTC announced its intent to broadly prohibit non-competition agreements, which are contracts in which an employee promises not to compete with their employer after they leave. There is a notice and comment period during which anyone can submit feedback supporting or opposing the proposed rule.
Do non-competes hold up in court? In certain circumstances, it is possible to find non-compete contract loopholes that may void the contract. For example, if you can prove that you never signed the contract, or if you can prove the contract is against the public interest, you may be able to void the agreement.
