A strike may consist of workers refusing to attend work or picketing outside the workplace to prevent or dissuade people from working in their place or conducting business with their employer. Less frequently workers may occupy the workplace, but refuse either to do their jobs or to leave.
Lawful Purposes A strike is legal and therefore protected by the NLRA if the employees are striking for economic reasons or to protest an unfair labor practice by the employer.
For example, it may be an unlawful strike to force an employer to fire an employee who does not make payments to the union when there is no union security agreement compelling those payments. There are other restrictions on the purposes of a strike.
Section 7 of the National Labor Relations Act states in part, Employees shall have the right. . . to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection. Strikes are included among the concerted activities protected for employees by this section.
Under federal law, you cannot be fired for participating in a protected strike or picketing against your employer.
A strike is a work stoppage caused by employees refusal to work, typically to protest an employer decision (to close a plant, freeze wages, cut benefits, impose unpopular work rules, or refuse to improve working conditions, for example).
Strikes are undertaken as part of the collective bargaining process that goes on between labor unions and employers in order to determine wages, benefits, working conditions, and in the case of public servants, legislation governing said services.
Workers may choose to protest unfair wages or other issues with their employer by going on strike. During a strike, workers do not provide any services to the company that employs them. However, there are rules against firing or otherwise retaliating against those who decide to go on a strike.
An unprotected strike, as the name suggests, does not enjoy the same protection and regulations that protect the employee as a protected strike. An Employer may find that an employee who participated in an unprotected strike actions to amount to serious misconduct which may result in dismissal from the company.
You will receive your final pay check for the last pay period including any overtime you worked, minus the days you are on strike. You cannot collect unemployment. If any strike lasts longer than five days, you will receive a union strike cash benefit to be determined by the International Union (OPEIU).
