A landlord must file a lawsuit in order to evict you. Your landlord cannot make you move by turning off your utilities. Also, your landlord may not evict you by locking you out, changing the locks or removing your personal property from the rental unit.
An oral lease on a month-to-month unit allows you to move out with just a one months notice. An oral lease also allows the landlord to refuse to continue to rent to you with one month notice. Additionally, a landlord can increase the rent with a written letter giving you a full rental periods notice.
Termination of a month-to-month tenancy usually only requires 30 days of notice by tenant and a landlord is required to serve a written notice of termination of tenancy on the tenant (see Service on Demand section below).
Answer: Your landlord does not have a leg to stand on. Once your lease expired, it did not automatically renew. If you have not already, you should provide your landlord with a written 30 days notice of your intention to move out. Once the 30 days have expired, you are free to move out.
If a landlord would like to terminate a month-to-month rental agreement or lease, the landlord will need to give the tenant a 30-day notice. This notice will inform the tenant that the tenancy will expire at the end of 30 days and the tenant must move out of the rental unit by that time (see 740 Ill. Comp.
The tenant cannot simply move out with no notice doing so will often result in loss of a security deposit or even a lawsuit for unpaid rent. Terminating a month-to-month lease requires at least 30 days written notice and a termination date that falls at the end of a rental period (usually the end of the month).
If there is no notice period stated in the lease, tenants in a month-to-month lease who want to move commonly give at least 30 days written notice before their next rent payment is due.
