If a joint petition or two or more petitions are pending in the same court by or against (1) spouses, or (2) a partnership and one or more of its general partners, or (3) two or more general partners, or (4) a debtor and an affiliate, the court may order a joint administration of the estates.
What is the clawback period? This 90-day period begins on the date that you file for bankruptcy. During this time, the trustee has the right to demand payment from creditors. If a creditor does not comply with the trustees request, the trustee can take legal action to recover the money.
Here is a list of Albertas bankruptcy exemptions: You are entitled to keep the necessary clothing for you and your dependents. You can keep enough food to support you and your dependents for up to 12 months. You can retain up to $4,000 in home furnishings and appliances. All medical and dental aids are exempt.
The court uses this information to make sure that creditors in a Chapter 7 bankruptcy dont receive more than their fair share. If you paid more than $600 to one or more creditors in the last 90 days, you can still file Chapter 7 bankruptcy.
This statute provides that when a debtor makes a payment to a creditor and the debtor files bankruptcy within 90 days of that payment, the Bankruptcy Court can force the creditor to pay that money back to the debtor for distribution to all of the debtors creditors.
Under bankruptcy law, you cant choose or prefer one creditor over another. Thats not to say you cant pay your regular monthly billsyou can. But, if you pay more than $600 to any other creditor within 90 days before filing, the Chapter 7 trustee can require the creditor to return the funds.
You can typically work to improve your credit score over 12-18 months after bankruptcy. Most people will see some improvement after one year if they take the right steps. You cant remove bankruptcy from your credit report unless it is there in error.
Your creditors and trustee and the Superintendent of Bankruptcy have the right to object to your discharge. The reasons why they may do that are set out in section 173 of the Bankruptcy and Insolvency Act.
