Section 7(1) of the Act provides that an arbitration agreement means an agreement by the parties to submit to arbitration all or certain disputes which have arisen or which may arise between them in respect of a defined legal relationship, whether contractual or not.
The key elements within these agreements, including clarity, consent, scope, rules, and procedures, are essential for the successful execution of arbitration.
The disadvantages of arbitration If the matter is complicated but the amount of money involved is modest, the arbitrators fee may make arbitration uneconomical. Strict court rules may prevent some evidence from being considered by a judge or a jury, but an arbitrator may consider that evidence.
