The working aged are employed people age 65 or over, and people age 65 or over with employed spouses of any age, who have group health plan (GHP) coverage because of their own or their spouses current employment.
Medicare Secondary Payor (MSP) rules have long said that Medicare pays second to a group health plan for the first 30-months of dialysis. Additionally, HIPAA Nondiscrimination rules prohibit discrimination in eligibility or continued eligibility for health plan coverage based on health factors.
The working age population is defined as those aged 15 to 64. This indicator measures the share of the working age population in total population.
Medicare is available to most individuals 65 years of age and older. Medicare has also been extended to persons under age 65 who are receiving disability benefits from Social Security or the Railroad Retirement Board, and those having End Stage Renal Disease (ESRD).
Providers are required to complete a Medicare Secondary Payer Questionnaire (MSPQ) upon admission of each Medicare patient. A sample of the MSPQ can be found in the Centers for Medicare Medicaid Services (CMS) Internet-Only Manual (IOM), Publication 100-05, Medicare Secondary Payer Manual, Chapter 3, Section 20.2.
The working-age is a patient 65 and older who has an Employer Group Health Plan (EGHP) coverage through his or her employment or their spouses employment.
BeneficiaryA person who has health care insurance through the Medicare and Medicaid programs.
Medicare is the secondary payer under the Working Aged provisions of MSP if all of the following conditions are met. First, the beneficiary must be age 65 or older and on Medicare because of age. Second, the insured person under the GHP must be either the beneficiary or the spouse of the beneficiary.
