A purpose trust is a particular type of trust which, unlike a conventional trust, can be formed to hold assets for a purpose without conferring a benefit on any person. An example of such a purpose is to hold shares in a company. An enforcer is appointed to oversee the activities of the trustees.
A Trust can be the beneficial owner but cannot directly hold the shares of a company. The trustees of the trust, either individuals or a corporate must hold the shares on behalf of the trust.
Discretionary trust The trustees have complete control over the assets and the income they generate, deciding how and when to give them to the beneficiaries. ` People may set up this kind of trust for their grandchildren, making the grandchildrens parents trustees.
A trustee can own company shares for the benefit of beneficiaries. For example, if you run your own company, you can set up a trust to hold your shares. If youre the trustee, you can distribute profits from the trust to yourself. However, as with all trusts, a trustee cannot be the sole beneficiary.
A Declaration of Trust outlines the shares a person has in a property. That Trust document will confirm what a deceased persons share was at the date of their death, and that their interest in the property, is to go as per the terms of their Will.
Declaration of trust relating to shares Where a company requires shareholders to fulfil certain criteria and the person does not, this document will allow someone who does to hold the shares on their behalf.
The most common example of when a declaration of trust is used is the situation where an adult son or daughter borrows money for a deposit on a first house from his or her parents. The parents may have a mortgage already, and the terms of that mortgage prevent them from borrowing under another.
This trust deed template is suitable for a discretionary trust, where the trustee has full control over the assets of the trust and has no obligation to return the funds to the settlor and the settlor cannot influence the trustee in any way.
