For most parents obtaining a new order that modifies your support may take at least 6 months. Please review the modification steps below and quickly respond to any requested information from our office to help speed up the process.
A good rule of thumb is to plan for 3 months for the entire process from beginning to end. The new amount of child support typically starts on the 1st month after the order, and does not apply retroactively to the date of filing the petition unless agreed to by the parties or ordered by the court.
Although a parent may not waive the right to child support, parents may come to a mutual agreement concerning the amount of child support to be paid by the non-custodial parent, so long as the agreed upon amount comports with the standards set out by Georgias Child Support Calculator.
Per C.R.S. 14-10-122(1)(a), child support in Colorado may only be modified in two situations: A substantial and continuing change in circumstances, or. The current order does not contain a provision regarding medical support (insurance and unreimbursed medical expenses).
To modify child support in Georgia, you must file a petition with the court. The petition must state why you request a modification and the support you believe is appropriate. You must also provide the court with documentation to support your claims. Once the petition is filed, the court will schedule a hearing.
For example, if a non-custodial parent were ordered to pay child support for one child, the support would range between 17% and 23% of the non-custodial parents income. As a matter of practice, judges typically awarded 20% of the non-custodial parents gross income for support.
Monthly support payment amounts can be increased if the custodial parent can prove the situation of the non-custodial parent has dramatically improved (i.e., substantial income increase, wins a lottery, receives an inheritance, etc.).
Support with Low Income Parents 14-10-115(7)(a)(II)(D) provides for a minimum support obligation applies unless both parents have at least 93 overnights. The monthly obligation is: $50 for 1 child. $70 for 2 children.
