Any indication of coercion, fraud, deception, threat, or physical force makes the agreement null and void. It must be fair. A postnuptial agreement cannot be unfair or unconscionable, meaning blatantly one-sided or otherwise unjust toward one spouse when considering the facts and circumstances of the relationship.
Several no-fault divorce states, such as California, Nevada, Iowa, and recently Hawaii, refuse to enforce infidelity clauses. The reason is that these clauses essentially punish someone for doing something wrong during the marriage, which is contrary to public policy in a no-fault divorce state.
A postnuptial agreement cannot provide enforceable terms for child support or custody. However, it can include provisions for alimony since that is considered separately from a spouses duties as a parent.
What is the infidelity clause in a post-nuptial agreement? An infidelity clause in a postnuptial agreement specifies the consequences if one spouse engages in infidelity, potentially including financial penalties or specific asset division terms.
An example of an infidelity clause in a prenup could be that the Agreement stipulates that if one spouse cheats, then that spouse must pay a penalty. Meaning if say, the wife cheats, then the husband gets $400,000.
One strategy that is sometimes used to dissuade further infidelity is to have the unfaithful spouse sign an infidelity post-nuptial agreement. This means the partner would consent to some specified financial payment (or another docHub item of value) to be paid if they cheat again.
Step-by-step guide to drafting a postnuptial agreement Step 1: Understand the purpose. Before you start drafting, grasp why youre doing this. Step 2: Itemize your assets and liabilities. Step 3: Determine how property will be divided. Step 4: Consider spousal support. Step 5: Put it in writing.
