There are two situations in which a work made for hire is produced: (1) when the work is created by an employee as part of the employees regular duties and (2) when a certain type of work is created as a result of an express written agreement between the creator and a party specially ordering or commissioning the work
For example, if an engineering firm hires an engineer to create software or hardware, the work-for-hire concept is in force, and the creations of the engineer are the property of the company. As long as the work is created in the scope of what an employee was hired to do, then its covered by work-for-hire law.
There must be a written agreement between the party that ordered or commissioned the work and individual(s) who actually created the work. 3. In the written agreement, the parties must expressly agree that the work is to be considered a work made for hire. 4.
What Is Work for Hire? Work for hire covers the legal ownership of copyrighted material. Generally speaking, when one entity (usually a business) hires someone (like an employee) to create something, then the work created belongs to the hiring entity, not the person who actually created it.
An employee is on a companys payroll and receives wages and benefits in exchange for following the organizations guidelines and remaining loyal. A contractor is an independent worker who has autonomy and flexibility but does not receive benefits such as health insurance and paid time off.
What Do You Give Up When You Sign a Work-for-Hire Agreement? Typically, you give up ownership of intellectual property rightsthe copyright or trademark. Those intellectual property rights transfer to the person or company who hired you when the deliverables have been met and you, as freelancer, have been fully paid.
A work for hire agreement is a written contract between an employer and an independent contractor (or contracted team or employee) to complete services in exchange for money. The agreement should outline the expectations and scope of the project.
35. The nine categories of works in 101(2) are: (1) a contribution to a collective work, (2) a part of a motion picture or other audiovisual work, (3) a translation, (4) a supplementary work, (5) a compilation, (6) an instructional text, (7) a test, (8) answer material for a test, or (9) an atlas.
