And most of the time when people are buying houses and rental properties and other investments, the most common type of deed that people use is called a warranty deed, and thats a deed where the seller is essentially promising that they have totally free and clear title to the property, and they are conveying it to that new buyer, and theres no title defects on record, so nobody else has any ownership, any liens on the property, or anything that would encroach their totally-unencumbered ownership of that particular property. To successfully execute a quitclaim deed in Michigan, the property owner needs to complete a quitclaim deed form and sign it in front of a notary. Then they pay any transfer taxes due and record the deed in the land recorders office in the county in which the property is located.
RECORDING FEES, TRANSFER TAX AND PAYMENT OPTIONS The fee to record a real estate document is $15.00 for the first page and $3.00 for each additional page or side.
Current Transfer Tax rate is $8.60 per $1,000, rounded up to the nearest $500. $7.50 is State Transfer Tax and $1.10 is County Transfer Tax. Transfer tax imposed by each act shall be collected unless said instrument of transfer is exempt from either or both acts and such exemptions are stated on the face of the deed.
Michigan uses quitclaim deed Form 863, which is different in each county, so make sure to get the form at the office or website of the County Register of Deeds in the county where the property is located.
If you are the person keeping the property, take the deed to the Register of Deeds and record it after your ex-spouse has signed it and delivered it to you. There will be a $30 recording fee.
Quitclaim deeds transfer only the part of the property the grantor actually owns, so if the grantor owns one-fourth of the property, thats all he can transfer to the grantee. If youre the grantee, be mindful that quitclaim deeds can be risky if you dont know or trust the grantor or know the propertys history.
Recording The quitclaim must be completed by filing with the Michigan Registry of Deeds.
A quitclaim deed transfers the owners entire interest in the property to the person receiving the property but it only transfers what he actually owns, so if two people jointly own the property and one of them quitclaims his interest to his brother, he can only transfer his half of the ownership.
