As of March 1, 2021, those terms have been replaced with words that are very similar to the language in B.C.s Family Law Act. Instead of custody, the Divorce Act now says parents have decision-making responsibility for their child. Instead of access, parents have parenting time.
There are three general categories of child custody: sole custody, joint custody, and split custody. The term sole custody refers to an arrangement where one parent has the legal responsibility for caregiving and making decisions that will affect the child.
Many people dont realize that there is a difference between guardianship and custodycustody refers to who has care of a child on a regular basis, whereas guardianship is about having parental rights and obligations to the child, even if the child is not in your care on a day-to-day basis.
When determining custody or access, a child should have as much contact with his or her parents as is in his or her best interests. The court will not consider the parents past conduct unless it affects the ability to parent or care for the child.
FILE the APPLICATION FOR AN ORDER by taking or mailing it to the Provincial Court Registry. There is no fee for filing an Application. If the form is accepted for filing, registry staff will set a date for you to attend before a judge.
If you have your parenting plan included in your order under the Divorce Act, it will be legally binding. If a parenting plan is submitted to the court, the court must include the plan in the parenting order or the contact order, as the case may be.
All guardians with parental responsibility for a child must agree about contact between the child and a person who is not a guardian. A written agreement about parenting arrangements or contact with a child may be filed in the court registry. The court can treat and enforce the agreement the same way as a court order.
50/50 schedules can benefit a child because the child spends substantial time living with both parents. This allows him or her to build a close relationship with both parents, and to feel cared for by both parents. 50/50 schedules work best when: The parents live fairly close to each other, so exchanges are easier.
