This is why I say exit interviews are a trap. Theres no upside, and a lot of downside. The best case scenario (positive change) is highly unlikely, and even if it happens, of no direct value to you. And the worst case scenario is retaliation that could haunt you for years.
1. You are not required to sign a release. Regardless of whether or not you sign a release, you are entitled to minimum statutory entitlements under Ontarios Employment Standards Act, 2000, (ESA) as amended, upon the termination of your employment.
An employer shall not require the employee to sign a release of the employees right to any wages that are due and earned by the employee, unless those wages have been paid. Some employers hold their employees final paycheck hostage until the employee signs a release or some type of termination form.
Remember: In order to be legally binding, your resignation must be handwritten and bear your signature. Furthermore, the name and address of the employer, as well as the date of your resignation, must be included in your letter. Its also important to indicate a concrete date when the resignation should be effective.
Keep in mind that exit interviews are completely voluntary. If a departing employee does not feel comfortable with the idea, there should be no repercussions if they decide to refuse.
You can decline an exit interview if you wish. However, consider your situation before you do. Remember that an exit interview is to help the company improve, so this is your chance to provide constructive feedback to the benefit of current and future employees.
