The Freedom of Information and Privacy Protection Act and the Municipal Freedom of Information and Privacy Protection Act provide for protection of employee personal information in the same manner that those statutes govern the personal information of other individuals.
The Employment Standards Act, 2000 (ESA) protects employees and sets minimum standards for most workplaces in Ontario. Employers are prohibited from penalizing employees in any way for exercising their ESA rights. Minimum wage Most employees are entitled to be paid at least the minimum wage.
Under the Quebec private sector privacy law (link), express consent to collection, use and disclosure of employee personal information is required. Under the federal law, PIPEDA, consent may be express or implied. In such cases consent typically is found in documents constituting an employees employment contract.
The witness will confirm that the employee is familiar with the document, yet refuses to sign it. If so, the supervisor may write on the form that the employee refused to sign and sign and date this statement. The witness also signs and dates this statement.
During and after the employment relationship, the employee must keep confidential, and refrain from using otherwise than for the employers benefit, the confidential information and trade secrets that the employer communicated or that the employee obtained through his or her employment.
Why do employers need to draft a Privacy Notice? It is a mandatory obligation under the GDPR for employers to provide certain information (detailed further below) to their staff. It is also a core GDPR principle for employers to process HR related data in a fair and transparent way.
The employee record must be held by the organisation and must relate to the individual. An employee record is defined under section 6(1) of the Privacy Act 1988 (Cth) to mean a record of personal information relating to the employment of the employee.
Privacy legislation in Canada generally provides that employers must collect, use and disclose personal information with employee consent. Consent is usually given expressly, either in writing or verbally.
