HIPAA does not prohibit the electronic transmission of PHI. Electronic communications, including email, are permitted, although HIPAA-covered entities must apply reasonable safeguards when transmitting ePHI to ensure the confidentiality and integrity of data.
Under HIPAA, your health care provider may share your information face-to-face, over the phone, or in writing. A health care provider or health plan may share relevant information if: You give your provider or plan permission to share the information. You are present and do not object to sharing the information.
Essentially any information that is patient-identifiable, even the patients address, is confidential and must be protected. Only when the patient has agreed may it be used or disclosed for specific purposes.
The HIPAA Privacy Rule explicitly lists an MRN as Protected (PHI), meaning that the Security Rule disallows sending it over an insecure system. By default, Office 365 would be considered insecure for this purpose.
If I send information to our billing service provider that does not include names, only the medical record number, and dates of service, is that considered PHI? Answer: Yes, the information is PHI, because it contains two identifiers, the MRN and the date, in connection with your office and future care.
See: (H) Medical record numbers; As the MRN can be used to reidentify, it is considered protected. If youre moving data that contains an MRN, you need to consider it as PHI and encrypt/secure appropriately.
Sharing inaccurate or outdated data could negatively impact patient care and increase the legal risks and liabilities for the end users who rely on it. If data comes from a system that does not have the most recent or corrected version of patient information, that would indicate a lack of data integrity.
Your health information cannot be used or shared without your written permission unless this law allows it. For example, without your authorization, your provider generally cannot: Give your information to your employer. Use or share your information for marketing or advertising purposes or sell your information.
