Contractors can generally file a lien on a property after completing work, which places a charge on the property's title. This charge prevents the property owner from dealing with the property without addressing the lien. For instance, if the owner is financing the build through bank loans, the bank will see the lien and may require its removal, often prompting the owner to pay the contractor or the holdback amount. This process helps ensure that contractors receive their owed payments.

If contractors and suppliers dont get paid on a construction project in Missouri, they can file a mechanics lien to secure payment. A mechanics lien is a legal tool that provides the unpaid party with a security interest in the property.
In North Carolina, a mechanics lien must be filed after the debt becomes due, but within 120 days from the date of last furnishing labor or materials to the project. If the claim is upon funds, there isnt a hard deadline for making a claim.
In such cases, owners can seek to bond off a mechanics lien. In plain terms, this means an owner can seek to substitute a surety bond for the underlying property in a mechanics lien claim. Basically, the surety bond replaces the property as security for the claim.
The cost to process each lien notification is $3.00 (three dollars) and the cost to print or release a lien is $1.50, excluding state gateway provider fees (see below). The NC DMV mandates a Gateway Provider fee for the transfer of each lien from the DMV to your account within the North Carolina ELT system.
Time and Fee for Filing a North Carolina Mechanics Lien For example, in Dare County, the fee is $6.00 for the first page and $0.25 for each additional page. The document that the lien claimant provides to the court should contain: Name and address of the lien claimant.
Iowa mechanics liens are documents that are filed against a property, essentially making a claim against that property. In the construction context, mechanics liens in Iowa are used when an agreement exists for work to be performed to improve property and the person doing the work is not paid for their services.
The short answer is yes. North Carolina law allows a person or company who improves real estate to file a lien against the owner of the property if the owner will not or cannot pay for the work.
Requirements for Filing a Mechanics or Construction Lien Most states have a 90 day filing deadline, while North Carolinas is 120 days, measured from the last substantial furnishing of labor and/or materials on the property. Any lien filed after this deadline will not be enforceable against the property.
