(Tennessee Code Annotated (T.C.A.) 28-2-101 onward.) Color of title means there is a document giving the appearance of title, but which document is not legally valid. In Illinois, color of title is a mere semblance of title passed by [a]ny instrument having a grantor and grantee, and containing a description of the lands intended to be conveyed, and apt words for their conveyancewhich purports to be a conveyance, but for some reason is not an actual conveyance.
A classic example of this is when the deed is executed by someone lacking legal capacity. If someone is mentally incapacitated due to extreme old age, for instance, then they lack the capacity to contract, and without a conservatorship in place, their purported conveyances will be void.
Texas law requires adverse possessors to have title or color of title. This comes in the form of a deed filed with the county recorders office that includes language indicating you are adversely possessing the property. The deed you file must be a warranty deed, not a quitclaim deed.
What is color of title? Defective title, or title received by defective means.
In other words, a person has color of title to a piece of property when, for one reason or another, the document evidencing title (a deed, for example) is invalid. Color of title is also known as apparent title since the document gives off an appearance of a valid title, but in reality, it is defective and invalid.
Quiet title actions are common following mortgage lender disputes, the death of title owners, cases of adverse possession, and long periods of time where the property is unoccupied. A quiet title action may not give the new owner the same level of protection against the previous owner.
