Maybe youre seeing a cardiologist or an ophthalmologist or a neurologist, theres lots of specialists in veterinary medicine. And this could also be things that youre gonna apply when youre gonna see your veterinarian because, guys, lets be honest, its really overwhelming when we take our pets to the veterinarian, again, whether theyre a general practitioner or a specialist. Often we have our pets with us, were worried, were concerned, theres a lot of distractions going on, so, Ive seen thousands of patients in my 20 plus years in veterinary medicine and Ill be honest, a lot of mistakes. While HIPAA does not protect the confidentiality of veterinary medical records, California law does. California, along with many other states, have passed confidentiality laws which protect information related to veterinary care and impose steep criminal, civil, and disciplinary penalties for their violation.
Your pets medical record should include: Identification details: your pets name, breed, age, and other identifying details, such as microchip number. Vaccination history: records of all vaccinations given, including dates and types of vaccines.
Unlike human healthcare facilities, veterinary practices are not directly governed by HIPAA.
Examples of organizations that do not have to follow the Privacy and Security Rules include: Life insurers. Employers. Workers compensation carriers.
You must request the records from your veterinarian - a written request is recommended. Under Business and Professions Code section 4855, the veterinarian is obligated to provide you with a summary of the patient record. The expectation is that the records will be provided within a reasonable amount of time.
Unlike people, pets are not protected by HIPAA, the law that guides medical privacy, because they are considered property and not persons (although there are many pet owners who would argue otherwise!) Like people, however, health information for pets and livestock collected at the vet also is protected by law.
