With respect to patent drawings that are not described as being drawn to scale, the U.S. Court of Appeals for the Federal Circuit cautioned that these may not be relied on to show particular sizes if the specification is completely silent on the issue. Hockerson-Halberstadt v.
Color drawings are acceptable in US patent applications, but not in international applications (see PCT Rule 11.13). For utility applications, the following are required for submitting color drawings [see see 37 CFR 1.84(a)(2)]:
Expanded and blown-up partial views of specific portions of the invention are allowed. If you need to show different views of the invention, group the drawings facing the same direction on the page. Drawings should be in the upright form, as opposed to horizontal landscape drawings.
Patent applications contain graphics, also known as patent drawings, illustrating the inventions, their embodiments (process or methods of carrying out invention), or the prior art. They are drafted manually or using modern tools to explain the invention better for an ordinary observer and examiner.
The first part of section 171 imposes four requirements for design patentability: novelty, originality, ornamentality, and the subject matter must be an article of manufacture.
The drawing must contain as many views as necessary to show the invention. One of the views should be suitable for inclusion on the front page of the patent application publication and patent as the illustration of the invention. Views must not be connected by projection lines and must not contain center lines.
This unique option of US design patent law gives applicants some flexibility to show certain parts of a product without claiming those parts. The dashed line feature also enables an applicant to show the environment or context surrounding the claimed design by illustrating, but not claiming, what is external.
Surface Shading Lines are used to shade surfaces and should be thinner than bold or thin lines. When shading cylindrical spherical surfaces, distance between the lines gradually increases. Closer together lines indicate the dark/shaded side and wider spaced lines indicate the light side of the object.
