hello glorias people uh this is divine notary and today i just wanted to share um some information um regarding a small estate affidavit now i have gotten some recent requests for small estate affidavit notarizations for my community and as a mobile notary you know i think that its something that um you know especially um you know people coming up or you know new to the notarization um space uh should just you know have more information about because um you know were here to help each other and just you know to spread information you know so that um we are all um you know knowledgeable you know about what is going on um so what exactly is a small estate affidavit now if you see me looking down im just looking at my notebook so that i can make sure that i get all my points okay so it is a document that allows a person to transfer and take responsibility for the decadence assets now what is a decadent someone that they know um a family member who may have died okay not may have died

A small estate affidavit is a form that the administrator of a deceased persons (known as the decedent) estate can use to collect the decedents assets, pay their debts, and distribute the balance of the estate to the decedents heirs and beneficiaries.
The document needs to state the following: The name of the person who died. The date and location of the death. That 40 days have passed since the death. That probate has not been initiated. That the estate value does not exceed $166,250. A description of assets to transfer. Names of other successors.
Many states require a waiting period after the death before the small estate affidavit can be presented for payment. However, Illinois does not require a waiting period so the small estate affidavit can be used immediately. Since the affidavit does not need to be filed with the court, there are no filing or court fees.
A small estate affidavit is a sworn legal document a person can use to assert a claim to assets from the estate of someone who has died. In Illinois, the affidavit is not filed with the court but can be presented to a person, bank, brokerage or other holder of an asset from the estate.
It is not necessary to hire a lawyer to file a small estate affidavit. In fact, many probate courts provide forms on their website for the publics use.
Once signed and docHubd, the affidavits must be filed with the probate court in the county where the property is physically located. A certified copy of the death certificate and a copy of the will, if any, must be attached to each affidavit, along with title documents for real estate and other large assets.
Though the affiant is not legally required to have a lawyer, it is wise for the affiant to hire one. It may seem wasteful to hire a lawyer when an estate is small, but many of the same rules that govern the full blown Illinois probate process apply to the affidavit.
You may be personally liable for any losses incurred by creditors or heirs if the information in your affidavit is incorrect. You may be accused of fraud if you knowingly misrepresent any information in the affidavit. You may be required to go through probate if your affidavit is not accepted by the court.
