Possible step: Apply for a without-notice order Attach an Affidavit (Word download) to the application to explain your situation and why it qualifies as an emergency. You can file the application with your petition or anytime after. The court will schedule a short hearing to review your application.
Sole or full custody It can be very difficult to persuade a judge to award this. You will need to show that the other parent is unfit to carry out parental duties usually due to one or more of the following: Substance abuse (alcohol/drugs) Mental illness.
The courts will either grant sole or joint custody. If sole custody is granted, one parent will be the sole decision-maker. If joint custody is granted, both parents are required to consent to major decisions about the child. A judge will make a decision about custody considering only the best interests of the child.
One parent might have sole custody. This means you live with one parent who takes care of you every day. Or both parents might have custody. This is called joint custody.
Some factors that the Court may review are: Age of the children. Living arrangement in the time prior to going to court. Connection the parents have with their children. Who made the decisions prior to going to Court. Relationship of the parents.
There is no specific age such as 12 or 14 when children get to decide who they will live with. Each child is unique, and their views are one factor that a judge will consider when deciding what parenting arrangement is in their best interests.
