An image licensing agreement is a legal document that outlines the terms and conditions of using photographs or images. The agreement serves as a contract between the photographer (licensor) and the company or individual who wants to use their photos (licensee).
Copyright law protects original works, including images. In most cases, you cant copy or distribute a copyrighted image without permission from the person who created it.
Exclusive rights give the buyer the right to use the photo in any way and prohibit anyone else from using it. Non-exclusive rights allow the buyer to use the image but allow others to use it. Limited rights allow the buyer to use the photo for a specific purpose, such as an advertisement, and prohibit other uses.
Fair Use comes allows you to use an image based on three conditions. First is if it used for limited non-profit and educational use. Second is if it is changed so drastically that it no longer has the same meaning or purpose, and third is if it is used informatively for the public good.
If you want to use someone elses copyrighted photograph, you will need to get permission from the copyright owner first. This is true even if you give credit to the photographer, as simply giving credit does not give you the right to use someone elses copyrighted material.
When an image belongs to the public domain, it means that it is not subject to copyright. Common cases are when the owner of the work passed away or abandoned all rights to the work.
The most common type of photography usage right is the right to use, which grants the image owner the right to use the photograph for personal, non-commercial purposes. Other common usage rights include the right to reproduce, the right to display, and the right to distribute.
Everyone has the right to control the use of their image, especially if being used to market or promote a brand, models included! This means that a model who is visible and recognisable in footage or an image has to agree to the purposes, territories, and timescale for which the content is used.
