Color is not an issue in trademark applications for word marks. If you are filing a design mark application, you need to decide whether or not to apply for the trademark in color. If so, you must include a color claim that specifies the exact colors in the mark. Your drawing must also be uploaded in color.
Images can be trademarked. So, if you are using an image to tell customers that a product or service comes exclusively from you, you can trademark the image. Trademarking an image is the best way to protect it for your brand. The answer to the question can you trademark an image? is yes!
Scan a high-quality original. Use software to crop, resize, and adjust the image to minimize white space around the design. For black and white or color images, ensure dots per inch (DPI) of 300-350, and pixel range of 250-944 for both length and width.
You can use whatever colors youd like, so long as the design itself doesnt change. If you do claim color, then youll submit your drawing (image) in the exact same color you wish to register as a trademark. And your design must appear in that same color whenever you share your mark.
Drawings submitted to the Office must be made on paper which is flexible, strong, white, smooth, non-shiny, and durable. All sheets must be reasonably free from cracks, creases, and folds. Only one side of the sheet may be used for the drawing.
Please send high-quality JPG. The USPTO will not accept PDF or PNG files. Unless you want to make color a part of your claims, send us a black-and-white (gray scale is fine) version of the logo. The image should be no smaller in any direction than 250 pixels and no larger in any direction than 944 pixels.
