Rent charges for 2022/23 This is in line with the 2022/23 permitted rent increase set by the housing regulator, which is the 2021/22 actual rent plus Consumer Price Index (CPI) 3.1% (September 2021) plus 1%. The average weekly rent will be increasing by 5.01 (4.1%).
All sections of the standard lease are mandatory and cannot be changed. When completed, the standard lease creates a contract between the landlord and tenant. This part provides more information about the rights and responsibilities of tenants and landlords under the act, starting on page nine.
Ontarios Courts have said that, to be valid and enforceable, an agreement to lease must show the parties, give a description of the premises, set out the commencement and duration of the term, the rent, and all the material terms of the contract that are not just incidental to the relationship of landlord and tenant.
Fixed-term: If you have a fixed-term tenancy, like a one year lease, then you must give notice at least 60 days before the end of the lease. The termination date cannot be before the last day of the fixed term. If you dont give notice, the tenancy continues.
Termination date must be the last day of the rental period or lease term. You can file this application online through the Tribunals Ontario Portal. Application must be filed no later than 30 days after the termination date in the notice. The tenant can dispute the application at the hearing.
For residential tenancies, the standard allowable rent increase for 2022 will be 1.5%. Subsidized housing, where rent is related to the tenants income, is not subject to rent increase laws. In these cases, the Residential Tenancy Branch does not have the authority to make decisions on rent increases.
The Province has set the 2023 Rent Increase Guideline at 2.5%. Landlords are reminded that rent increases may take effect on January 1, 2023 provided there has not been an increase in the last 12 months or the tenant not moved in the last 12 months.
At present, Ontario landlords can increase tenants rent by up to 1.2% so long as they give the proper notice at least 90 days before the increase. This number will stand until the end of 2022.
