37 CFR 1.165 Plant drawings. (b) The drawings may be in color. The drawing must be in color if color is a distinguishing characteristic of the new variety. Two copies of color drawings or photographs must be submitted.
For international drawings, color is not permitted: at most you may include grayscale photos or drawings. Because of this, as well as the obstacles to using color drawings even with the USPTO, our office prepares drawings in grayscale and black-and-white unless a client specifically requests color drawings.
11.13 Special Requirements for Drawings. (a) Drawings shall be executed in durable, black, sufficiently dense and dark, uniformly thick and well-defined, lines and strokes without colorings.
Color drawings are acceptable in US patent applications, but not in international applications (see PCT Rule 11.13).
There should be a proper black and white line drawing, which is highly preferred by almost all of the judiciaries, along with the USPTO. Also, when you are submitting patent drawings, the sheets should be free from any folds or creases. Only one side of each sheet should be used.
11.13 Special Requirements for Drawings. (a) Drawings shall be executed in durable, black, sufficiently dense and dark, uniformly thick and well-defined, lines and strokes without colorings.
Separate from the specification, a patent application is required to contain drawings if drawings are necessary to understand the subject matter to be patented. Most patent applications contain drawings. The drawings must show every feature of the invention as specified in the claims.
