Under Californias leave of absence laws, employees are allowed to take time off for certain short or extended periods without losing their job. If you are requesting or taking a leave of absence in any one of the circumstances protected by law, you may be entitled unpaid leave.
Despite both terms referring to periods of non-attendance at work, they differ in several ways: Eligibility: Leaves of absence are granted based on company policies, while FMLA eligibility hinges on meeting specific criteria set by federal law.
When you voluntarily take a period of leave without pay, authorized by your employer, it is considered as quitting your job. If the reason for voluntarily taking a period of leave is without just cause, you will not be paid regular benefits for the entire period of the leave.
You cannot work while on a leave of absence.
So, if you were out on FMLA and, while you were out, you decided to look for another job and found something that may be better suited for you, theres nothing prohibiting you from giving your notice to your employer and moving on to a subsequent employer and starting over as you see fit.
