A warranty deed is a real estate document that warrantsor promisesthat the grantor (seller) owns the property free and clear and there arent any outstanding mortgages, liens, judgments or other encumbrances against it.
The guarantees of a general warranty deed are known as covenants. Traditionally, there are six covenants of title which can be divided into present covenants and future covenants.
A warranty deed offers the grantee or buyer protection from inheriting any liens or future claims made against the property. If there are problems with the propertys title after the sale has been completed, the warranty deed holds the grantor or seller liable for resolving them.
A quitclaim deed is usually the weakest deed because it offers the least amount of protection. Quitclaim deeds are often used to transfer ownership between spouses or family members, while a general warranty deed is used for arms-length transactions.
The warranty of ownership assures the buyer that: The property is free of all rights except those declared by the seller. The seller has discharged the property of all hypothecs, except for those assumed by the buyer. The property is not subject to any encroachment on the part of the seller or a third person.
