Mortgage liens If you have unpaid tax debt, the CRA can place a lien on your home and any other assets you may have to try and reclaim their money. They can place a lien on your property without your permission, but you will receive a notice beforehand to inform you that a certificate of arrears has been registered.
Timing for Liens The Preservation of the Lien. A Lien Claimant has 60 days to have a lien preserved on title.
A lien is a legal claim on an asset to satisfy an unpaid debt. In other words, if you owe money to someone and fail to repay it, they can file a lien against your home and other property you own. That means they have a right to keep possession of it until you pay your debt in full.
A motion to vacate a construction lien is typically filed by the property owner or another party with an interest in the property. The motion must be filed in the Ontario Superior Court of Justice and must set out the grounds on which the party seeks to have the lien removed.
Following preservation of a construction lien by registering the lien on title to the subject property, the lien must then be perfected by issuing a statement of claim and certificate of action with the Superior Court of Justice. The certificate must also be registered against title to the property.
In Ontario, liens are only valid for 90 days from the date of last on site working. If your customer refuses to pay within the first 30-60 days, legal action or collections may be an additional action you want to take to help enforce your lien.
How does a Mechanics Lien work? Provide a pre-lien notice. A pre-lien notice informs the hiring party (and any other relevant parties) of your involvement in a specific project. Provide notice of intent to lien. Create and file the lien. Notify and serve the property owner. Release the lien or seek legal action.
A lien can be placed on a premises once the work has been completed or the materials have been supplied. The lien remains on the premises until the debt is paid, until a court order is obtained to remove the lien, or the property is sold by court order.
