This is, however, not the case with a month-to-month agreement. Any party can terminate it as long as they have provided the other party with proper notice. In North Carolina, youll need to provide your tenant with a Notice to Vacate to end a month-to-month agreement.
For month-to-month leases, there must be seven days of notice. For year-to-year leases or those with other definite terms, landlords must notify the tenant, or vice versa, within a month of the end of the lease. On leases lasting between one week and one month, notice must be given at least two days in advance.
In North Carolina, there are legal requirements that must be met to ensure the validity of a lease agreement: The agreement must be in writing. The security deposit must not exceed two months rent. The landlord must provide a 30-day notice before increasing the rent.
North Carolina law says that your landlord must keep your housing fit and safe. It also says that you, the tenant, must pay your rent, keep your home clean, and not damage your home.
