Since I have you here, Ngozi, I have to ask you about the broken dispute resolution, settlement mechanism. And the Americans have been holding up the appointment of appellate judges. Supposedly reform needs to happen of the WTO before theyre willing to make that happen. Is that moving forward? - Yes. Yes, it is. First, just to correct one thing, the system is really not broken. Its two tiers. So theres a panel level and last year, 17 cases were brought and cases are being brought every day. - And they get resolved at the panel level. - Yeah, yeah. The panel gives a judgment. The problem we have is quite rightly, like you said Ian, the second tier, the appellate body is not functioning because, as you said, the U.S. blocked the election of judges into that tier. The Appellate Body can uphold, modify or reverse the legal findings and conclusions of a panel, and Appellate Body Reports are adopted by the Dispute Settlement Body (DSB) unless all members decide not to do so.
The WTOs top decision-making body is the Ministerial Conference. Below this is the General Council and various other councils and committees. Ministerial conferences usually take place every two years. The General Council is the top day-to-day decision-making body.
The General Council discharges its responsibilities under the DSU through the Dispute Settlement Body (DSB). Like the General Council, the DSB is composed of representatives of all WTO Members. The DSB is responsible for administering the DSU, i.e. for overseeing the entire dispute settlement process.
The Dispute Settlement Body (DSB) of the World Trade Organization (WTO) makes decisions on trade disputes between governments that are adjudicated by the Organization. Its decisions generally match those of the Dispute Panel.
The aim of the dispute settlement mechanism is to secure a positive solution to a dispute. A solution mutually acceptable to the parties to a dispute and consistent with the covered agreements is clearly to be preferred.
The DSB has authority to establish dispute settlement panels, refer matters to arbitration, adopt panel, Appellate Body and arbitration reports, maintain surveillance over the implementation of recommendations and rulings contained in such reports, and authorize suspension of concessions in the event of non-compliance
