Cal/OSHA requires that when temperature in the workplace exceeds 80 degrees, shade structures must be erected if no other shade is readily available.
Every year, dozens of workers die and thousands more become ill while working in hot or humid conditions. OSHAs Heat Illness Prevention campaign educates employers and workers on heat hazards and provides resources to keep workers safe.
Regulations require minimum of five minutes in shade California Code of Regulations, title 8, Section 3395 mandates that all employers with outdoor places of employment implement a heat illness prevention program that includes, among other requirements, providing workers cool-down periods of at least five minutes
OSHA does not set specific temperatures at which workers can refuse to work. However, workers have the right to refuse work that they believe poses an imminent danger of death or serious harm, including unsafe heat conditions.
In 2005, the heat-related deaths of four farmworkers prompted California to adopt an outdoor heat illness prevention rule, which requires shade and water when the temperature hits 80 degrees and, for farming and construction work, additional breaks and monitoring when it hits 95.
