Simon Harris: Thank you very much Chris and thank you for the kind introduction. So just a little bit about myself. I have been working with a contracting authority for the last two years or so to help establish a framework agreement. So it is a really great opportunity to be with you all today to speak about our experiences to date. And I understand that there are about 300 or so of you here with us today so again, it is great to see that this is such a popular topic. Right, so just looking at the agenda. So topic one we are going to cover in quite a bit of detail some framework principles that underpin the current system. Topic two we are going to look at a few developing issues that have arisen from those principles themselves. Topic three, a quick look at dynamic purchasing systems and what authorities have to do to set those up. The fourth topic, framework reform. So we will take a look at the Cabinet Office Spring Paper that was published in December 2020 and see what that means

In the context of negotiations, a framework agreement is an agreement between two parties that recognizes that the parties have not come to a final agreement on all matters relevant to the relationship between them, but have come to agreement on enough matters to move forward with the relationship, with further details
Framework agreements are contracts designed to set out the general conditions for future procurement during a given period and especially defines the cost of those procurements. Furthermore, there must be an anticipated order volume. The aim of this is to simplify procurement practice.
What is a Framework Contract? A framework contract is a document that outlines the terms and conditions for an ongoing business relationship between two or more parties. The purpose of a framework agreement is to establish rules, responsibilities, and expectations when working together.
For example, framework contracts may include pre-agreed minimum order quantities that the procurer must place with the supplier. They may also include a maximum order quantity for a given price or period.
However a framework agreement is more likely to not be a contract itself, but merely an agreement about the terms and conditions that would apply to any order placed during its life. In this case, a contract is made only when the order is placed and each order is a separate contract.
Framework agreements can limit competition, as they often require the parties to work exclusively together. This can prevent the parties from seeking out the best suppliers or subcontractors, which can limit the quality and efficiency of the work.
Framework agreements enable organisations to engage in long term budgeting and planning, knowing they have reliable economic operators for their ongoing needs. Organisations can negotiate better contractual terms, conditions and prices with the economic operators, saving costs over time.
