Your notice must be in writing, so avoid email, text messaging, and social media. Instead, give your landlord a signed and dated letter with your name, signature, address, and move-out date, as set out in section 52 of the RTA. See TRACs template letter, Notice to Move Out.
Dear (Name of landlord or manager), This letter constitutes my written (number of days notice that you need to give based on your lease agreement) -day notice that I will be moving out of my apartment on (date), the end of my current lease. I am leaving because (new job, rent increase, etc.
For example, a tenant can mail their one-month notice to move out, but should never send it using text or social media messaging.
Proper notice is required in written form, to the end of the term or lease, giving a notice period of at least 60 days. Text communication would not be deemed legal notice.
A text message is not a legally recognized notice to vacate so you can ignore it. The notice would start the day you receive the proper legal notice in writing.
Any time you write a letter or email to your landlord, keep your language clear and concise to eliminate any potential for confusion. Include relevant details such as the date of writing, the dates of any instances referenced within the letter, and your contact information and unit number.
Although the RTA requires landlords to prepare tenancy agreements in writing, it also says that a tenancy agreement can be oral, express or implied. This means that you and your landlord do not have to sign an agreement to establish a legal tenancy in BC.
Legal considerations: While a text message can initiate the resignation process, it may not be sufficient as a formal record or proof of your intent to resign. Many employers require a written resignation letter or email as a legal and administrative requirement.
