Alaska judges decide custody based on what is in the childs best interest. Alaska courts do not give preference to one parent over the other because of their sex. Instead, the judge must consider all of the following factors when determining custody: the childs physical, emotional, mental, religious, and social needs.
The most common joint custody arrangements include the 2-2-3 plan and the 2-2-5 plan. Both involve spending alternate sets of days with either parent. Also common is the alternate week plan, where the child spends one week with a parent and the next week with the other.
There are 2 options for legal custody: sole legal custody or joint legal custody. A judge may give you or the other parent sole legal custody. A parent with sole legal custody has the right to make major decisions about the child, while the other parent does not have that right.
50/50 schedules can benefit a child because the child spends substantial time living with both parents. This allows him or her to build a close relationship with both parents, and to feel cared for by both parents. 50/50 schedules work best when: The parents live fairly close to each other, so exchanges are easier.
The maturity of each child, in addition to the bond between the child and each parent, are just as important as age. Our attorneys have seen 7 year olds handle a week on / week off schedule better than some 11 year old kids. With that being said, one blanket approach wont be beneficial for all.

If a court order is not in place, Maine law presumes that parents have equal rights and responsibilities to care for and raise their children. Parents also have a duty to support their children financially, to the extent they are able.
If a custody case is pending, but there is no order, generally the standing order in the case will prohibit either parent from removing the children from the state of Alaska without the permission of the other parent or a court order.
