An abandonment notice is a written statement that must be displayed in a prominent, accessible position on the property informing the tenant that the locks have been changed and where to find a replacement key if they wish to return.
Section 48(1) of the RTA permits the landlord to give notice of termination to a tenant if the landlord, in good faith, requires the unit for residential occupation for a period of at least one year by the landlord, a specified family member or a caregiver. This notice is often referred to as a N12 notice.
Goods can be removed, stored, sold, or otherwise disposed of after a reasonable period of time which is currently set at 14 days following the end of the tenancy. Landlords also have the right to get rid of any perishable goods - such as food that might be going off.
If for some reason you are unable to serve your notice in person or by registered mail, you should be aware that email or text does not constitute valid notice under the guidelines of the RTA or by Service Alberta.
You must give your landlord at least 30 days notice. If you have a daily or weekly tenancy, you must give the landlord at least 28 days notice.
Notice must be given in ance with the Personal Property Security Act and can be done any time after the items are abandoned (i.e. during the 60-day storage period), but at least 30 days before they are sold.
Proper notice is required in written form, to the end of the term or lease, giving a notice period of at least 60 days. Text communication would not be deemed legal notice. In your situation, you should minimize your losses by trying to re-rent the unit.
The Ontario Court of Appeal has defined abandonment as a giving up, a total desertion and absolute relinquishment of goods by the former owner. The party relying on the defence bears the onus of proof and must demonstrate, on a balance of probabilities, that the owner intended to abandon the chattels.

Written notice can be sent by mail or email. But if you tell the collection agency you dont want to receive emails and give them your address, they must send you the written notice by mail.
