A comprehensive photo consent form should include the name and contact information of the photo owner, a clear statement granting permission for the use of the photos, the purpose of the photo use, any limitations or restrictions on the use of the photos, and the signature of the photo owner.
Not all patient photos contain PHI but are identified as health information. A patient photo is considered to contain PHI if it has any of the following patient identifiers: Any portion of the face.
Is it illegal to take photos in hospital? It is not illegal to take photos in hospital. However, when a photo is taken in hospital by a Covered Entity or a member of a Covered Entitys workforce, what happens to the photo after it has been taken is governed by the HIPAA Privacy and Security Rules.
Workforce members are allowed to take photos and videos of patients, but only for a use or disclosure required or permitted by the Privacy Rule. Photos taken for any other purpose require a written authorization from the patient which explains why the photo is being taken and who it will be shared with.

Informed consent for the use of each image and each purpose must always be obtained from the patient or guardian. Specific and fully informed consent for photography should always be sought and granted before taking photographs.
Posting a photo of a patient on social media is considered a disclosure if the photo identifies the individual and either the photo or a description of the photo implies a past, present, or future treatment relationship.
