What Pictures Qualify as Protected Health Information (PHI)? Any photo that shows individually identifiable information is considered PHI. This can be something such as a patients face, name or initials, their date of birth, the date of their treatment or photos of any birthmarks, moles or tattoos.
The only times taking a picture of a patient is a HIPAA violation is when a picture is taken by a member of a Covered Entitys workforce without the authorization of the patient and/or for a use or disclosure not permitted by the Privacy Rule.
A written authorization should be obtained from the patient or the patients legal representative prior to photographing the patient for medical education, staff teaching, or publicity purposes. Consent is not necessary prior to photographs or other images being used in telemedicine or on the Internet.
The Designated Record Set defines all documents that together create a medical record. This must be clearly defined as it applies to your paper and electronic patient records. Therefore, for photographs to be properly controlled they must be identified as part of the designated record set.
The HIPAA law about taking pictures in a hospital environment is that it is okay for a Covered Entity or members of a Covered Entitys workforce to take pictures provided the pictures are for a permissible use or disclosure and that the individually identifiable health information of any person in the picture remains
