A last will is a legal document used to transfer assets upon an individual's death. The person who creates the will is known as the testator or grantor, while the recipients of the assets are termed beneficiaries. Validity requirements for a will vary by state, but generally, it must be executed by a person with testamentary capacity, written, and signed in the presence of two witnesses or at the testator's direction. Testamentary capacity implies the testator is at least 18 years old and of sound mind, assessed at the time of signing. Competence entails understanding the nature of the property, those receiving it, and the intended distribution plan. Subsequent incompetence does not invalidate a will.
