Typically, we consider a proxy to be someone who reports an outcome as if they were the patient themselves. An observer, on the other hand, is someone other than the patient that is able to assesses observable signs, events, or behaviors related to a patients health condition.
Choose a person you trust to make decisions in line with your wishes. Your health care proxy can be a family member, your spouse, or a friend. This person will be able to talk to your doctors, look at your medical records, and make decisions about different tests or procedures if you are unable to do so yourself.
While both there proxy and surrogate should receive the same resources, support and information as the patient, in many states the proxy has greater decision-making authority. Determine if the patient has designated a healthcare proxy and review all documents that provide guidance about the patients prior wishes.
To name a health care proxy, you can use an advance directive called the durable power of attorney for health care. An advance directive is a legal document that provides instructions for medical care and only goes into effect if you cannot communicate your own wishes.
When deciding who to name as attorney in fact, consider four things about potential people: 1) Trust. The person named in a POA must be trusted to do what the principal wants and needs. 2) Competency. The attorney in fact must be capable of handling the tasks the principal needs done. 3) Capacity. 4) Communication.
A medical power of attorney, also called a durable power of attorney for health care, is a legal document. In it, you grant another person the authority to make medical decisions for you if you become unable to do so. The person you choose is your health care agent (health care proxy, health care surrogate).
What three decisions cannot be made by a legal power of attorney? A power of attorney cannot change or invalidate a will, act outside of the principals best interest, or violate the terms of nominating documents, and cannot make decisions on behalf of the principal after their death.
