appeal - A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is to appeal or to take an appeal. Both the plaintiff and the defendant can appeal, and the party doing so is called the appellant.
court fee ($210 in Supreme and County Courts; $65.00 in New York City Civil Court) If you are unable to pay this fee, you may ask the court for a fee waiver. in Supreme Court you must also submit a Request for Judicial Intervention (RJI) to have a Judge assigned to the case. There is no fee to file this form.
A litigant who files an appeal of a district court decision is known as an appellant. The term petitioner is used for a litigant who files an appeal from an administrative agency or who appeals an original proceeding.
The technical legal word for the people who are part of a court case and have a right to ask the court to make a decision on a dispute. At the trial level, the parties are typically called the plaintiff or petitioner and the defendant or respondent. On appeal, parties are called the appellant and appellee.
The side that files the appeal is called the appellant. The other side is called the respondent. If you appeal, the appellate court will review the trial court record to decide if a legal mistake was made in the trial court that changed the outcome of the case.
The next four variables identify the parties to the case. Petitioner refers to the party who petitioned the Supreme Court to review the case. This party is variously known as the petitioner or the appellant. Respondent refers to the party being sued or tried and is also known as the appellee.
You will need to pay a filing fee at the time of submitting the forms. (This varies from around $70 to $200. For reference, the fee in St. Marys County is $135.)
