Confirm the gift with a gifted deposit letter The letter should lay out that the giver has no right to the property. This is known as a gifted deposit letter. This letter proves that you wont have to pay back the money given at a later date.
First, the donor, or giving party, must perform some act constituting the actual or symbolic delivery of the subject matter of the gift. Second, the donor must possess an unequivocal intent to give. Third, the donee, or receiving party, must accept the gift.
To prove a gift, you can use documents or communications to prove the person gave the item to you (such as emails or text messages). Additionally, you can use your verbal testimony as well as the testimony of witnesses to prove that the item was given to you gratuitously.
A gift letter should include the following information: The exact dollar amount of the gift. The donors name, address, and phone number. The donors relationship to the loan applicant. The date when the funds were or will be transferred. A statement that no repayment is expected.
Transferring property or money by way of gift must be executed as a Deed because no consideration is given in return for the gift, thus the document has to be witnessed. Please note that the witnesses have to be disinterested parties. In other words they cannot have a stake in the transfer of the property.
Gift letters are required by mortgage lenders as documentation to prove that the funds received are a gift, not a loan, and that the donor is not involved in the home purchase. The gift letter is an official document that verifies the nature of the received money as a gift, with no expectation of repayment.

What are the risks of signing a gift letter? There arent necessarily any risks in signing a gift letter as long as you dont need the funds to be repaid. The only time an issue may arise is if you give the money under the guise of a gift, but actually intend it to be a loan.
