Forbearance is the intentional action of abstaining from doing something. In the context of the law, it refers to the act of delaying from enforcing a right, obligation, or debt. For example, a creditor may forbear legal action against the debtor if they settle the debt payment with new payment conditions.
Forbearance Fee is defined in Section 4.10. Forbearance Fee means a fee equal to 4.00% of the principal amount of the First Lien Credit Agreement Loans of each Consenting First Lien Credit Agreement Lender outstanding immediately prior to the Open Market Buy-Back Date.
As part of a standard mortgage forbearance agreement, the lender agrees not to foreclose on your home for missed payments. After the forbearance period ends, youll still need to make up the payments you missed, but there are a couple of ways to do this, including making a lump sum payment.
To the contrary, a forbearance agreement expressly preserves the default, and the lender only agrees to refrain from exercising its remedies during the forbearance period. A waiver agreement, on the other hand, waives the default and restores the parties to their pre-default positions.
A waiver of default is a legal document that releases a party from any liability for failing to meet the terms of a contract.
Lenders monitor covenants regularly to ensure the borrower remains creditworthy throughout the loan period. Violating covenants could trigger an immediate issuance of a forbearance letter and agreement. Banks include covenants in loan agreements to help ensure the loan will be repaid by the borrower.
