In short: If you created an original image, you own it. That ownership gives you exclusive rights to display and reproduce what you create. If you didnt create it, you need permission to use it.
A photo licensing agreement is a contract between two parties, the licensor (the photographer who owns the copyright and is licensing the rights to use the image) and the licensee (the person or company wanting to and gaining the right to use the image).
A photography services agreement outlines each partys rights and responsibilities, and allows the parties to negotiate and determine the services to be provided. The enclosed document can provide a good starting point for your contracting arrangement.
File Sharing Service. Using a file-sharing service is a straightforward way to give your clients access to your gallery of photos. File-sharing services let you create a link you send to your clients that will get them to their photos even if they are not the most technologically sophisticated.
A photo release is your legal permission slip to use the photo for your own commercial or other purposes. Common uses of photographs that require release forms include stock photos or designing a new brochure or portfolio.
A blanket release permits any use of the photographic image of the person signing the release and is suitable if the company or photographer needs an unlimited right to use the image. Stock photographers who sell their photos for unlimited purposes commonly use blanket releases.
When you get a photo license, it means you have obtained permission to use a photo in a certain manner. It doesnt mean that you own the image outright, however, just that you may use the image for a certain period of time. Think of it this way: a license is like a permission slip for a field trip.
Any commercial photography contract should include the section of payment that specifies: Your total service fee. Retainer fee (non-refundable deposit) Payment method (cash, cheque, or credit card) Payment due date (when will the client pay you) Late fees (if the payment is not made on time)
